Program Design (& Coaching) Liability Release, PAR-Q and Questionnaire

    Upon accepting this Client Agreement and payment of the Service Fees, you will be deemed to have automatically accepted this Client Agreement and all the terms and conditions set forth herein.

    If you wish to decline this Agreement or any term or condition, you must exit online form. No refunds issued after receiving initial training program and/or nutrition manual.

    The Strength Guys Inc. Service Providers: Jason Tremblay, Ben Esgro, Arian Khamesi, John Downing, Nicola Paviglianiti, Charlotte Peyraud, Tori LaPerriere, Urban Mur, Nicolas Peyraud, Patrick Carr, Jayne Jones, Julianna King, Jonathan Chua, Hendrik Becker, Jaime Cortés, Jeff Butt

    LIABILITY RELEASE

    1. The Client hereby releases, indemnify, and hold harmless, the Service Providers from any and all manner of actions, causes of action, suits, proceeding, debts, dues, contracts, judgments, damages, claims and demands whatsoever in law or equity stemming from the agreement between the below mentioned parties.

    2. Client expressly agrees that this release, waiver, and indemnity clause is intended to be as broad and inclusive, and if any portion thereof is held invalid, it is agreed the balance shall, notwithstanding, continue in full legal force and effect.

    3. I have no known physical or mental condition that would impair my capability to participate fully, as intended or expected of me.

    4. I have carefully read the foregoing release and indemnification clause and understand the contents thereof.

    5. I fully understand the risks of participating in physical activity and agree that the Service Providers shall not be held liable in the case of any training related injury or death.

    GENERAL PROVISIONS

    1. CLIENT acknowledges before beginning, implementing, or using any and all of recommendations provided, that CLIENT should consult a medical doctor.

    2. CLIENT acknowledges that client is not authorizing to disseminate, share, convey, or transfer any recommendation, either orally or written, provided by the Service Provider without his express written consent.

    3. It is the responsibility of the athlete to adhere to their plans and promptly inform your coach and Jason@thestrengthguys.com if issues or concerns arise.

    TERMS AND CONDITIONS

    In consideration of the above referenced release, the named parties have agreed to the following terms:
     
    1. SERVICES INCLUDED :All services listed on website depending on package chosen.In exchange for listed price + GST (GST applicable to residents of Canada only) 

    2. PAYMENTS:  CLIENT understands payment due upon receipt of invoice. Late payments will result in service disruption. Invoicing occurs MONTHLY regardless of length of your program or block.

    3. NOTICE WHEN NEW PROGRAM REQUIRED: CLIENT must send email to coach at least one week before needing a new program. CLIENT understands if appropriate notice not given to coach, new program may be delayed. Program Design Only CLIENT must check in monthly. If CLIENT does not check in, new program will not be designed by SERVICE PROVIDER.
     
    4. COMMUNICATION: The Strength Guys Inc. is an online coaching company, phone calls or video calls are not included in standard service offering. If CLIENT would like to arrange a call, texts or social media chat with coach, please discuss with him or her directly. There may be an additional charge depending on nature of request.
     
    SERVICE PROVIDER will respond to emails within 48 hours (business days).

    5. DISCOUNTS: To qualify for discounted package prices, you will be asked to pay for first and last month upfront (no refunds). Discounts cannot be combined

    6. CANCELLATIONS: CLIENT may cancel at anytime by sending email to SERVICE PROVIDER.

    7. REFUNDS: No refunds after services rendered.
     
    8. COMPLAINTS: The Strength Guys Inc. treat all complaints seriously. If CLIENT is having an issue or has a complaint, CLIENT should email billing@thestrengthguys.com and/or Jason@thestrengthguys.com promptly.

  • By submitting this agreement, I hereby agree that I will not take any substance on the current WADA prohibited list unless I have a Therapeutic Use Exemption (TUE).

    Failure to comply will result in termination of the contract with no refund. 

    If you would like further information, please email billing@thestrengthguys.com . If you are using a prohibited substance, we will contact you asking for details.
  • Expectations of the Client

     

    1. The Client will adhere to the recommendations/interventions as written.
    2. The Client will discontinue any exercise and notify the Coach immediately if it is painful. 
    3. The Client will provide the Coach the same respect as they would expect to be given at their own job(s) regarding illnesses, travel, personal matters, etc.
    4. The Client understands that the Coach will not contact the Client requesting check-ins or follow-ups. The Coach expects that the Client will provide these materials at their regularly scheduled times. The Coach will not reprimand the client if they make a mistake, nor will the Coach attempt to force the client to implement something that they do not desire for themselves.
    5. The Coach will not be expected to be the Client’s tutor and "teach" them how to coach training or nutrition.
    6. Any issues the Client has will be calmly and professionally brought to the Coach's attention so they can be mutually resolved. 
    7. The Client will never replicate, reproduce, or reuse the materials the Coach provides them for anyone other than themselves. 
    8. The Client must understand trivial matters, and those not directly relevant to consulting will not be prioritized (check-in emails are always a priority). Although the Coach will always do their best to address any issues, if it is not essential or relevant to the Client’s progress, the issue will be considered a low priority compared to essential emails (check-ins). 
    9. It is understood that the Coach and the Client have a business relationship while Consulting. 

      IMPORTANT:   If Client needs to make any changes to payments (cancel, pause, change payment date, etc.), Client MUST email billing@thestrengthguys.com.   

      Client cannot assume their Coach will handle anything payment-related.

     

     

    Expectations of the Coach
     

    1. Clients will always be addressed respectfully.
    2. Client communications will be addressed within 48 hours on business days unless an excusable reason is presented.
    3. The Client should never feel like "just another client" (or the Coach is impersonal with them). If this is the case, the Client will express their feelings and concerns with the Coach. 
    4. The Coach will adequately address client concerns when reasonable and applicable to the service(s) they are paying for.
    5. The Client’s plan will be adequately adjusted when there is a lack of response over time to the current plan.
    6. Program(s) given to the clients are efficacious, and the Coach’s expectations of the Client are reasonable. Most importantly, the programs are safe and considerate of the Client’s physical and mental well-being.
    7. The Coach will concede when they are no longer qualified to address or consult on certain matters about areas outside of their expertise.
    8. The Coach will consistently provide the service on time by the agreed-upon start day of each training week.
    9. The Coach will never share the client’s personal or private information with outside parties/individuals without the client’s consent. (i.e., progress pictures, financial information, health/medical information, etc.)

     

  • By submitting this form, I acknowledge that I have read and understood the aforementioned
    terms. This contract is NOT legally binding, it is simply to ensure both parties maintain realistic
    expectations for the consultation period.
